Idaho requires a provider-patient relationship to be established before delivering virtual care
Summary
Idaho's Virtual Care Access Act requires providers to first establish a provider-patient relationship meeting Idaho's community standard of care before delivering telehealth. Treatment based solely on a static online questionnaire is not acceptable.
Idaho law requires clinicians to establish a provider-patient relationship meeting the community standard of care before delivering virtual care. While the relationship may be established via telehealth, treatment based solely on a static online questionnaire does not satisfy the standard. This requirement constrains certain low-touch, asynchronous telehealth models and direct-to-consumer platforms serving Idaho patients.
